Terms of Service
These terms form the agreement between you and NOTSU OÜ (registry code 16305121), the operator of PadelSmash. Please read them before creating an account.

1.Who we are
PadelSmash is operated by NOTSU OÜ, an Estonian private limited company, registry code 16305121, VAT number EE102489600, registered office Harju maakond, Tallinn, Põhja-Tallinna linnaosa, Soo tn 2, 10414, Estonia. In these terms “PadelSmash”, “we” and “us” mean that company, and “you” means the person using the service.
PadelSmash is a social and competitive padel platform. We help players find each other, organise games and tournaments, track ratings and results, buy and spend closed-loop app credit called SmashTokens, and order goods from the PadelSmash Store. We are not a gambling operator and we do not present ourselves as one.
2.Eligibility and age
- You must be at least 16 to hold a PadelSmash account, and at least 18 to use any feature involving a participation fee, Game Buy-In, prize pool or purchase of SmashTokens.
- Where a feature requires you to be 18+, you must self-declare your age; we may require further checks before enabling that feature and may withdraw it at any time.
- You must have legal capacity to enter this agreement in your country of residence, and you must not use PadelSmash where doing so is unlawful for you.
- Availability of a feature in the app is not a statement that it is lawful for you. You remain responsible for your own compliance with local law.
3.Your account
- You register with an email address, magic link or a supported social sign-in. One account per person.
- You are responsible for keeping your credentials and email inbox secure, and for activity carried out through your account.
- You must give accurate registration and profile information and keep it up to date.
- You may close your account at any time — see the Account deletion page and the deletion tool in your profile settings.
- We may suspend or terminate accounts as set out in clause 13.
4.Profile data, ratings and Playtomic information
Your PadelSmash profile can include a display name, photo, city and country, preferred hand and side, years of experience, clubs, availability, bio and play style. You control profile visibility (public, friends or private) in your profile settings.
- PadelSmash rating is calculated by us from confirmed results using an Elo-style model, and is not a certification of ability.
- Playtomic rating is self-reported by you, or taken from a public Playtomic profile link that you choose to add. It is always labelled as its own source and is never labelled verified unless an authorised integration verifies it.
- We do not scrape private or authenticated Playtomic data. Booking on Playtomic happens on Playtomic under their terms; we only deep-link and let you import a booking reference.
- Ratings, streaks, badges and recent form may be recalculated, corrected or reset if results were entered incorrectly or manipulated.
5.Games: public, private and invitations
- A public game is visible in Find a Game and can be joined by any player who meets the creator's criteria (for example level range, city or club, approval required or auto-join).
- A private game is not listed publicly and is only reachable through a direct invitation or invite link. Invitations can be pending, accepted or declined.
- The creator sets the club or court, date and time, format, court cost and any participation fee, and is responsible for the accuracy of that information.
- Joining a game is a commitment to other players. Repeated no-shows or late cancellations may affect your reliability signals and can lead to restrictions.
- PadelSmash is not a party to the game itself. We are not the organiser, referee, coach or insurer of any match played offline.
6.Court costs and Game Buy-Ins are separate
We always model and display two different amounts. Court cost is what the court actually costs, split according to the rule chosen for the game. Game Buy-In (also shown as Entry Fee or Challenge Entry) is an optional competition contribution that funds a Prize Pool.
- Court cost total and court cost per player are shown separately from entry economics.
- Where a Prize Pool exists, the game screen shows gross entry pool, the PadelSmash service fee, the net prize pool and the projected reward per winning player before you join.
- The applicable service fee percentage is disclosed in the game or checkout screen at the moment you commit.
- In Winner Plays Free games, all players contribute according to the selected rule and, after a confirmed result, the winning pair's court share is covered from the defined settlement. This is a cost-sharing arrangement, not a betting product.
7.SmashTokens
- SmashTokens are first-party, closed-loop app credit issued by us. They are not money, not electronic money, not a payment instrument and not a financial product.
- Purchased tokens are bought with a card payment through an authorised payment provider. Promotional and earned tokens are granted by us, for example for referrals, promotions or rewards.
- The ledger keeps purchased, promotional, earned, reserved, spent and pending reward balances distinguishable, and every movement is recorded for audit.
- Tokens are non-transferable between users and cannot be cashed out. Cash-out only becomes possible if a lawful, provider-approved payout feature is explicitly enabled for your country, and that feature does not exist by default.
- Tokens have no value outside PadelSmash. If your account is closed for breach of these terms, unused promotional and earned tokens are forfeited.
8.Payments and providers
- Ordinary commerce — store purchases, memberships and non-prize court payments — is processed by our commerce payment provider.
- Competition-related flows, where they are enabled at all, are routed to a separate provider under a hard server-side routing rule; they can never be sent through the commerce provider.
- Real-money competition functionality is off by default and only appears where both a payment-provider approval flag and a country legal-review flag are set for your country.
- Where those flags are not set, competition mechanics run on promotional or test SmashTokens with no cash or material prize payout.
- Prices are shown including applicable VAT where required. Invoices are issued by NOTSU OÜ under Estonian law.
9.Results, confirmation and disputes
- A result becomes final when both pairs confirm it in the app, or when we resolve a dispute.
- Ratings, streaks, settlements and any rewards only move after a confirmed or resolved result.
- If pairs disagree, either side can open a dispute. We may ask for evidence, may pause any settlement, and may decide the outcome on the balance of the information available.
- We aim to resolve disputes within a reasonable time. Our decision is an internal platform decision and does not remove your statutory rights.
10.Tournaments
- Tournaments may be run by us or by an organiser using our tools, in knockout, round-robin or group-plus-knockout formats.
- The tournament page states the entry requirements, any entry fee, the prize or reward structure, registration limits and eligibility rules before you register.
- Registration may be limited, waitlisted or closed; a schedule may change for court, weather or entry reasons.
- The same payment, provider and country gating in clause 8 applies to tournament entries and rewards.
11.Store orders and physical goods
- Store products may be priced in euro, in SmashTokens, or both. Availability and stock are shown at checkout.
- A contract is formed when we confirm your order. If an item turns out to be unavailable, we cancel and restore the tokens or refund the payment.
- Delivery times are estimates. Risk passes to you when you or a carrier chosen by you receives the goods.
- Your statutory rights for defective goods and the EU right of withdrawal for distance contracts are set out on the Refunds page.
12.Referrals and promotions
- Each player gets a personal invite link. Rewards for referrals are promotional SmashTokens and are configured by us; the qualifying action and amount are shown when the programme is active.
- Self-referral, duplicate accounts, bulk automated sign-ups and other manipulation void the reward and can lead to account action.
- Promotional balances may carry expiry or usage conditions, which we state when they are granted.
13.Acceptable use, suspension and termination
- Follow the Community & Fair Play rules. Do not harass, threaten, discriminate, impersonate, post illegal or infringing content, or share other players' personal data.
- Do not manipulate results, ratings, tokens, referrals, prices or provider flows, and do not attempt to access other accounts, our servers or admin functions.
- We may restrict features, withhold a settlement, suspend or terminate an account where we reasonably believe these terms or the law have been broken, or where required for security, fraud prevention or a legal obligation.
- Where practical and lawful we tell you the reason and let you respond. You may also terminate at any time by deleting your account.
14.Your content and our intellectual property
You keep the rights to the photos, text and results you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, display and adapt that content only as needed to run PadelSmash — for example showing your profile to players you allow, or rendering a shareable result card you generate.
The PadelSmash name, logo, design, code, database and rating model belong to NOTSU OÜ. Do not copy, resell or scrape them without written permission.
15.Availability and changes
We work to keep PadelSmash available, but we do not promise uninterrupted service. Features may change, launch in test mode, or be withdrawn — particularly features that depend on a payment provider, an external booking service or a country flag.
We may change these terms. If a change materially affects you, we give reasonable prior notice in the app or by email, and you may close your account if you do not accept it.
16.Liability
Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for intentional misconduct or gross negligence, or under mandatory consumer protection law.
- Padel is a physical sport. You play at your own risk and are responsible for your own health, insurance and equipment. Court operators are responsible for their venues.
- We are not responsible for the conduct of other players, for third-party booking services, or for a club cancelling a court.
- Subject to the above, our aggregate liability arising from your use of PadelSmash in any 12-month period is limited to the amounts you paid us in that period.
17.Governing law, complaints and jurisdiction
These terms are governed by Estonian law. If you are a consumer resident in the EU, you keep the protection of the mandatory rules of your own country of residence, and you may bring proceedings in your local courts. Nothing in this clause removes those rights.
- Please contact us first through the contact page — most issues are resolved quickly.
- Estonian consumers may also turn to the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority.
- EU consumers may use the European Commission's online dispute resolution platform where it applies.
- Data protection complaints can be sent to the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon) or your local supervisory authority.
